Terms of Use
These terms are an agreement between you and BatMonkey Games LLC, a California company ("we", "us"), for using the Thumb Wars app, its Messages extension and its online features. By using Thumb Wars you agree to them. Apple's Licensed Application End User License Agreement also applies; where the two differ on the app license, Apple's agreement governs.
1. Who can play
Thumb Wars is for people 13 and older. If you are under 18, you need a parent's or guardian's permission to use it, and they agree to these terms for you.
2. Thumb Wars Premium
- Premium is an auto-renewing monthly subscription. The price is shown in the app before you buy (US $0.99 a month at launch; it may differ in other countries).
- Payment is charged to your Apple Account when you confirm the purchase.
- It renews automatically each month unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
- You can manage or cancel it at any time in the Settings app: tap your name, then Subscriptions. Cancelling stops the next renewal; Premium stays on until the end of the period you paid for.
- Apple handles all billing and refunds. To ask for a refund, go to reportaproblem.apple.com.
- Restore Purchases in the app's Settings brings Premium back on a new phone signed in to the same Apple Account.
- We may change what Premium includes or its price. A price increase follows Apple's rules, which include telling you in advance.
3. No gambling, no cash value
Thumb Wars has no real-money games, bets or prizes. XP, levels, belts, mystery boxes, cosmetic items and poker chips are part of the game only. They have no cash value, cannot be bought (except where the app sells Premium), sold, traded or transferred, and cannot be exchanged for money or anything of value. Please don't use Thumb Wars to settle bets with other people.
4. Playing fair and being decent
Thumb Wars includes a chat, voice messages, and names that other players see. When you use them, you agree not to:
- harass, threaten, bully or impersonate anyone;
- send hateful, sexual, violent or illegal content, or anything that sexualizes minors;
- send spam, or share other people's private information;
- cheat, hack, overload or interfere with our servers or other players' games, or copy, change or resell the app.
You are responsible for what you send. We can remove content, and stop anyone who breaks these rules from using our online features where we are able to. To report someone, email support@thumbwarsgames.com.
5. Your content
The names, messages and voice notes you send stay yours. You give us permission to pass them to the people you are playing with and to handle them as our Privacy Policy describes, only so the app can work.
6. Our content
The app, its games, art, sounds and the Thumb Wars name belong to BatMonkey Games LLC or its licensors. You may use the app for your own personal, non-commercial play.
7. Changes and availability
Thumb Wars is a young app and will change. We may add, change or remove games and features, and online features may sometimes be unavailable. We may update these terms; if a change is significant we will say so in the app or on this page, and the new terms apply once you keep using the app after the effective date.
8. Disclaimer
Thumb Wars is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not promise that it will be error-free or always available, or that your progress can never be lost.
9. Limit of liability
To the extent the law allows, BatMonkey Games LLC is not liable for indirect, incidental, special or consequential damages, or for lost data or progress, arising from your use of Thumb Wars. Our total liability for any claim is limited to the amount you paid us for Premium in the 12 months before the claim, or US $50, whichever is greater. Some places do not allow these limits, so they may not apply to you.
10. Law
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in California, unless the law where you live gives you the right to bring it there.
